Terms of Service

1. Who you are contracting with
MinistryAlign ("MinistryAlign", "we", "us", "our") is a product of Otech Labs LLC, 33 W Palmer St, Danielson, CT 06239, United States. My Walk is the personal experience inside MinistryAlign and is covered by these terms. By using MinistryAlign you ("you", "user") enter into a binding agreement with Otech Labs LLC.
2. Acceptance of these terms
By creating an account, signing in, or completing a purchase, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service. We record the version of these terms in effect when you create your account.
If you use MinistryAlign on behalf of a church or other organization, you represent that you are authorized to bind that organization to these terms, and "you" includes that organization.
3. The service
MinistryAlign is a web and mobile platform that helps churches understand, place, and care for their members and volunteers using spiritual-gifts, DISC, passion, and skills assessments, ministry matching, scheduling, and communication tools. My Walk provides personal devotional features — a daily verse, journal, faithful moments, and a personal profile — that belong to the individual and travel with them between churches.
4. Eligibility and age
You must be at least 13 years old to hold an account. MinistryAlign is not directed to children under 13, and we do not knowingly collect their personal information. Users aged 13–17 may use the service only through a church workspace, with the involvement of that church and, where applicable, the consent of a parent or guardian. A church that enrolls minors is responsible for obtaining that consent.
The service is offered from the United States and is intended for users in the United States. It is not directed at residents of the European Economic Area or the United Kingdom, and we make no representation that it complies with the local requirements of other countries.
5. Your account
You must provide accurate information, keep it current, and keep your credentials confidential. You are responsible for activity under your account. Tell us promptly at hello@ministryalign.app if you believe your account has been accessed without your permission.
6. Church workspaces, roles, and responsibilities
A church workspace is controlled by that church through its admins. As between the church and us, the church decides what member information is collected in its workspace and who may see it; we process that information on the church's behalf and on your instructions as a user.
The church agrees that it:
- has the authority and any consent required to add members and to enter or upload information about them;
- is responsible for what its admins and leaders do inside the workspace, including who they grant access to and how they use member information;
- keeps its roster and roles accurate, and removes access promptly when someone leaves a role;
- will use assessment results only for ministry placement and care, never for employment, hiring, discipline, or any decision described in Section 8;
- maintains at least one active admin, and hands off ownership before that admin leaves. If a workspace is left without an admin we may, at your request, assist with an ownership transfer to a verified church representative.
Individual members
When you join a church workspace, that church's admins and the leaders of the teams you serve on can see your ministry profile — your name, contact details, gifts, passions, style, skills, and how you fit each team. That visibility is the point of the product, and joining is your choice. Your journal, reflections, private notes, and personal My Walk content are never visible to your church. You may leave a church at any time, which ends leader visibility going forward.
When a church's subscription ends or its workspace is deleted, the church's workspace records are removed or anonymized after a reasonable export window. Your personal My Walk data remains yours and stays with your account.
7. Acceptable use
You agree not to:
- use the service for any unlawful, deceptive, or fraudulent purpose;
- send spam, harass, threaten, or abuse anyone through the service;
- upload another person's sensitive information — including religious, health, or minors' information — without the authority or consent to do so;
- infringe the intellectual property, privacy, publicity, or other rights of any person;
- interfere with the security or integrity of the service, including by uploading malware, probing for vulnerabilities, scraping at scale, or circumventing access controls, seat limits, or rate limits;
- reverse engineer, decompile, resell, sublicense, or redistribute the service except as expressly permitted by law;
- use the service to build a competing product, or to train a machine-learning model on its content or outputs.
8. Assessments are ministry tools, not professional advice
Spiritual-gifts, DISC, passion, and skills results, match percentages, health indicators, and any coaching language in MinistryAlign are ministry-fit tools designed to start good conversations. They are not psychological, psychometric, clinical, medical, diagnostic, or employment-screening instruments, they are not validated for employment use, and they are not professional, legal, financial, medical, or pastoral-counseling advice.
You agree not to use MinistryAlign results as a basis for hiring, firing, promotion, compensation, background screening, tenancy, credit, insurance, or any other decision with legal or similarly significant effects, and not to treat them as a substitute for professional care. Placement decisions are made by people, not by the software.
9. AI-assisted features
Some features use automated or AI assistance to draft suggestions — for example team blueprints, summaries, or wording. Those outputs can be incomplete or wrong. They are suggestions only; a human reviews and decides. You are responsible for what you publish or act on. We do not use your journal, reflections, or private notes to train or fine-tune AI models.
10. Your content and our intellectual property
You keep ownership of the content you create or upload. You grant us a limited, worldwide, non-exclusive licence to host, store, transmit, display, and process that content solely to operate and improve the service for you and, where applicable, your church. That licence ends when the content is deleted, except for copies retained in routine backups until they age out.
We retain all right, title, and interest in the service itself — software, assessments, content, models, branding, and documentation. You receive a limited, non-exclusive, non-transferable right to use the service for its intended purpose during your subscription. Aggregated, de-identified statistics that cannot reasonably identify you or your church may be used to operate and improve the service.
If you send us feedback or ideas, you grant us a perpetual, royalty-free licence to use them without obligation to you.
11. Subscriptions, trials, billing, and auto-renewal
Church plans are sold as monthly or annual subscriptions, with seat capacity per plan and optional seat packs. Annual plans are billed for the full term up front. My Walk is free; optional support contributions unlock nothing.
- Free trial. Where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before it ends. Cancel during a trial and you are not charged.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period — monthly plans monthly, annual plans annually — at the then-current price, until you cancel. You may cancel at any time from the Billing page inside the app; cancellation stops future renewals and you keep access through the end of the period you already paid for.
- Payments. Payments are processed by Stripe. Depending on your location, Stripe may handle tax calculation, collection, and remittance and act as merchant of record for that transaction; otherwise Otech Labs LLC is the seller of record and Stripe processes the payment. Card details are entered on Stripe's PCI-compliant checkout and never touch our servers.
- Taxes. Prices exclude taxes unless stated. You are responsible for any applicable sales, use, or similar taxes.
- Price changes. We may change prices for future billing periods with at least 30 days' notice by email or in the app. Your current paid period is unaffected, and you may cancel before the change takes effect.
- Failed payments. If a payment fails we may retry it, notify you, and suspend paid features until the balance is settled.
- App store purchases. If you purchase through the Apple App Store or Google Play, that store's terms, billing, and refund rules govern the transaction. Manage or cancel those subscriptions in your store account; we cannot issue refunds for store-billed purchases.

12. Third-party services
MinistryAlign works with third parties — including Stripe for payments, email and push delivery providers, cloud hosting, the Apple App Store and Google Play, and optional church integrations such as Planning Center and Subsplash. Those services are governed by their own terms and privacy notices, and we are not responsible for their acts, omissions, availability, or content. Connecting an optional integration authorizes the exchange of the data that integration requires; you may disconnect it at any time.
13. Availability, changes, and beta features
We work hard to keep the service reliable, but we do not warrant that it will be uninterrupted, error-free, secure from all threats, or available at all times. We may modify, add, or discontinue features; if we discontinue a material feature of a paid plan we will give reasonable notice. Features labelled beta, preview, or experimental are provided as-is and may change or end without notice.
Disclaimer. To the fullest extent permitted by law, the service is provided "as is" and "as available", and all warranties — express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of results — are disclaimed.
14. Electronic communications
You consent to receive notices, agreements, and disclosures electronically — by email to your account address or in the app. Service messages about your account, security, and billing are part of the service and cannot be turned off while your account is active. Marketing email is sent only with your consent and includes an unsubscribe link. Push notifications are optional and controlled in your device and app settings.
15. Copyright complaints
If you believe content on MinistryAlign infringes your copyright, email hello@ministryalign.app with the subject "DMCA" and include: the work claimed to be infringed, the material and its location, your contact details, a statement of good-faith belief that the use is unauthorized, a statement that your notice is accurate under penalty of perjury, and your physical or electronic signature. We respond to valid notices, including by removing content and terminating repeat infringers.
16. Suspension and termination
We may suspend or terminate access if you materially breach these terms, fail to pay, create a security, legal, or fraud risk, or repeatedly or seriously violate our policies — with notice where practical, and immediately where the risk requires it. You may cancel at any time from the app or delete your account from Settings.
On termination your right to use the service ends. We provide a reasonable window to export your data, after which we delete or anonymize it in line with our Privacy Policy — personal data is removed within 30 days of an account deletion request, except where law requires us to keep it and until routine backups age out.
17. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for all claims relating to the service is limited to the greater of the fees you paid us in the twelve (12) months before the event giving rise to the claim, or one hundred US dollars ($100). We are not liable for indirect, consequential, special, incidental, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or ministry outcomes, even if advised of the possibility.
Nothing in these terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
18. Indemnity
You will defend, indemnify, and hold harmless Otech Labs LLC and its members, officers, and personnel from third-party claims, damages, liabilities, and reasonable legal fees arising out of your content, your use of the service in breach of these terms, your church's collection or use of member information, or your violation of law or of another person's rights.
19. Governing law and venue
These terms and any dispute relating to them or to the service are governed by the laws of the State of Connecticut, United States, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Subject to Section 20, the state and federal courts located in Connecticut have exclusive jurisdiction, and you consent to that venue — except where mandatory consumer law gives you the right to another venue.
20. Dispute resolution — arbitration and class-action waiver
Please read this section carefully. It affects how disputes are resolved.
Talk to us first. Before filing anything, email hello@ministryalign.app describing the problem and the relief you want. We will try in good faith to resolve it within 60 days. Most issues end here.
Arbitration. If we cannot resolve it, you and Otech Labs LLCagree that any dispute will be settled by final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, in Connecticut or — at your election — remotely or in the county where you live. The arbitrator decides the dispute and may award the same individual relief a court could.
Small claims. Either of us may instead bring an individual claim in small-claims court if it qualifies. Either of us may also seek injunctive relief in court to stop infringement or misuse of intellectual property or unauthorized access to the service.
No class actions. Disputes are brought only in an individual capacity. You and we waive any right to bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims without both parties' consent. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.
Your 30-day opt-out. You may reject this arbitration section by emailing hello@ministryalign.app with the subject "Arbitration opt-out", your name, and your account email, within 30 days of first accepting these terms. Opting out costs you nothing and affects nothing else — Section 19 then governs your disputes. If a later amendment changes this section, you get a fresh 30 days to opt out of that change.
21. Changes to these terms
We may update these terms. When changes are material we will raise the version above and notify you in the app or by email before they take effect. Continued use after the effective date means you accept the updated terms; if you do not, cancel and stop using the service.
22. General
- Entire agreement. These terms, the Privacy Policy, and the Refund Policy are the whole agreement between us about the service and replace earlier understandings.
- Order of precedence. If a signed written agreement with us conflicts with these terms, that agreement controls for the conflicting part.
- Assignment. You may not assign these terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control, including outages of upstream providers, natural events, or government action.
- Severability and waiver. If a provision is unenforceable, the rest stays in force. Not enforcing a right is not a waiver of it.
- Survival. Sections on content and IP, disclaimers, liability, indemnity, governing law, and dispute resolution survive termination.
- Notices. Legal notices to us go to hello@ministryalign.app and to Otech Labs LLC, 33 W Palmer St, Danielson, CT 06239, United States. Notices to you go to your account email.
- Export and sanctions. You may not use the service in violation of US export controls or sanctions, or from an embargoed country.
- No agency. These terms create no partnership, employment, agency, or joint-venture relationship.
